Why Do I Need An Online Cloud Backup?

Computers have come a long way in the last few years and the need to backup seems to many, to be getting less important, why because computers are far more reliable then they have been previously.

So why do I need a cloud backup?

While it is true that computers have become far more reliable, new dangers have appeared in the last few years that mean that having an offsite backup is now probably more important than it has ever been in the past. The major issue that we have today is Ransomware, this is where a Trojan or a Virus is introduced to a computer, it encrypts files and locks the user out on their own data, the only way to get access to this information again is to pay a ransom, this is generally between $1500 to $2500 dollars US. Many people find paying a ransom to be just too expensive. There is also the risk of theft or fire and just plain old hard drive failure. Many think well I can just start again, believing lost information can just be redone, but what can be lost. MyBackup - Terms of Use

Where the context admits: "MySales ", "We", "Our" & "Us" This refers to: Mysales Nelson Limited, 367 Nayland Road, Nelson New Zealand. MySales back-up offsite is an online storage service that Users to store files online via software named MyBackup.

This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the MySales, MyBackup Service. By using the MySales, MyBackup Service, you agree to be bound by this Agreement. You are only authorized to use the MySales, MyBackup Service if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should l discontinue use of the MySales, MyBackup Service immediately.

MySales may modify this Agreement from time to time and such modification shall be effective upon posting by MySales on the MySales Websites. MySales will inform Users by email about such modifications where practical to do so. If you do not agree with such modification you have the right to terminate your MyBackup usage with MySales. You agree to be bound to any changes to this Agreement when you use the MySales, MyBackup Service after the modification has been posted for at least one month. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

1. Use of the MySales, MyBackup Service
1. Use of and MyBackup usage in the MySales, MyBackup Service is void where prohibited to use the service by local law.

2. By using the MySales, MyBackup Service, you represent and warrant that:

3. All registration information you submit is truthful and accurate;

4. You will maintain the accuracy of such information;

5. You are 18 years of age or older;

6. Your use of the MySales, MyBackup Service does not violate any applicable law or regulation;

7. When you sign up to become a User, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account or password of another User at any time or to disclose your password to any third party. You agree to notify MySales immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

8. You will create, maintain and use only one User account and password on the MyBackup service.

9. You will not use the MySales, MyBackup Service in any manner which infringes any law or regulation or which infringes the rights of any third party, nor will you authorise or permit any other person to do so.

10. Without limiting the foregoing, you will not use the MySales, MyBackup Service for any of the following activities:

10.1 Criminal or tortuous activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;

10.2 Advertising to, or solicitation of, any User to buy or sell any products or services through the MySales, MyBackup Service. You may not transmit any chain letters or junk email to other Users. It is also a violation of these rules to use any information obtained from the MySales, MyBackup Service in order to contact, advertise to, solicit, or sell to any User without their prior explicit consent;

10.3 Any automated use of the system, such as using scripts to add friends or copy files;

10.4 interfering with, disrupting, or creating an undue burden on the MySales, MyBackup Service or the networks or services connected to the MySales, MyBackup Service;

10.5 Attempting to impersonate another User or person;

10.6 using the account, username, or password of another User at any time or disclosing your password to any third party or permitting any third party to access your account;

10.7 selling or otherwise transferring your MyBackup usage;

10.8 using any information obtained from the MySales, MyBackup Service in order to harass, abuse, or harm another person or Company;

10.9 using the MySales, MyBackup Service in a manner inconsistent with any and all applicable laws and regulations;

10.10 We shall use our reasonable endeavours’ to make available to you at all times the MySales, MyBackup Service but we shall not, in any event, be liable for interruptions to or unavailability of the MySales, MyBackup Service.

10.11 MySales reserves the right, in its sole discretion, to reject, restrict, suspend, or terminate your access to all or any part of the MySales, MyBackup Service at any time, with or without prior notice.

2. Content
1. MySales does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you upload to the MySales, MyBackup Service.

2. You represent and warrant that you’re uploading any Content to the MySales, MyBackup Service does not violate the privacy rights, publicity rights, intellectual property rights (including copyrights), contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content uploaded by you to the MySales, MyBackup Service.

3. Without limiting the foregoing, you will not upload any Content to the MySales, MyBackup Service which:
1. is patently offensive or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
2. Harasses or advocates harassment of another person;
3. exploits people in a sexual or violent manner;
4. contains nudity, violence, or offensive subject matter or contains a link to an adult website;
5. solicits personal information from anyone under 18;
6. Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
7. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
8. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
9. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
10. solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
11. involves commercial activities and/or sales without Our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
12. includes a photograph of another person that you have uploaded without that person's consent;

4. By using the facilities of the MySales, MyBackup Service to make Content available to other Users ("Shared Content"):
1. You grant to MySales a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute your Shared Content on and through the MySales, MyBackup Service. The license you grant to MySales is non-exclusive, perpetual, fully-paid and royalty-free, sub-licensable, and worldwide;
2. You represent and warrant that you own the Shared Content or otherwise have the right to grant the license set forth in this section;
5. MySales may delete from the MySales, MyBackup Service any Content that in the sole judgment of MySales violates this Agreement or which we deem inappropriate.
6. MySales assumes no responsibility for any error, omission, interruption, loss, deletion, defect, theft, destruction or unauthorized access to, or alteration of any Content you upload to the MySales, MyBackup Service.
7. You are solely responsible for the Content that you upload to the MySales, MyBackup Service, and any material or information that you transmit to other Users and for your interactions with other Users. MySales does not endorse and has no control over the Content. Content is not necessarily reviewed by MySales and does not necessarily reflect the opinions or policies of MySales. MySales makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to other Users.
8. MySales assumes no responsibility for monitoring the MySales, MyBackup Service for inappropriate Content or conduct. If at any time MySales chooses, in its sole discretion, to monitor the MySales, MyBackup Service, MySales nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User uploading any such Content.
9. The MySales, MyBackup Service contain Content of MySales ("MySales Content"). MySales Content is protected by copyright, trade secret and other laws, and MySales owns and retains all rights in the MySales Content and the MySales, MyBackup Service. MySales hereby grants you a limited, revocable, non-sub-licensable license to reproduce and display the MySales Content (excluding any software code) solely for your personal use in connection with viewing the MySales Website and using the MySales, MyBackup Service.
10. MySales assumes no responsibility for monitoring the MySales, MyBackup Service, the user’s data integrity, or the data uploading scheduling.

5. Copyright Policy
1. You may not share, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of MySales to terminate MyBackup usage privileges of any User who repeatedly infringes the copyright rights of others upon receipt of prompt notification to MySales by the copyright owner or the copyright owner's legal agent.
2. Without limiting the foregoing, if you believe that your work has been copied and posted on the MySales, MyBackup Service in a way that constitutes copyright infringement, please provide us with the following information:
1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
2. A description of the copyrighted work that you claim has been infringed;
3. A description of where the material that you claim is infringing is located on the MySales, MyBackup Service;
4. Your address, telephone number, and email address;
5. A written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

6. Fees
1. All charges payable by you for the MySales, MyBackup Service shall be in accordance with the scale of charges and rates published from time to time by Us on Our web site or agreed on via email, errors and omissions excepted and shall be due and payable in advance of provision of the MySales, MyBackup Service.
2. We reserve the right to alter pricing including ceasing to offer elements of the MySales, MyBackup Service free of charge at any time. MySales will inform Users by email if the charge for a service is to be altered. You can then decide if you want to continue to use such service. Your continued use of the service after the proposed fee modification has been notified will be considered acceptance of the proposed fee modification.
3. Payment is due each anniversary month, quarter or year following the date the MySales, MyBackup Service were established until closure notice is given
4. All fees for our services are due in advance and your contract will automatically renew on its anniversary month, quarter or year at which point fees for the following month, quarter or year become payable. If you wish to cancel your contract with MySales, you must do so in writing 1 month before the renewal of your contract.
5. If your MyBackup usage is terminated, you will be entitled to a pro rata refund based upon the remaining period of prepayment. You will not be entitled to a refund under any other circumstances. Any refund will be issue to the same payment source used for the initial payment.

7. Free Trial Period
1. Where services are offered on a ‘free trial’ basis payment will be taken for the first month, quarter or year at the commencement of the free trial period.
2. The renewal date for the contract shall be deemed to be one month, quarter or year following the advertised free trial period.
3. If you wish to cancel your contract during the free trial period you may do so.
4. If you cancel your service during the free trial period you will be entitled to receive a full refund of all fees paid in relation to the service. Any refund will be issue to the same payment source used for the initial payment.
5. If you do not cancel your service prior to the end of the free trial period the fees for the first month, quarter or year of your service will become due.

8. Term and Termination
1. This Agreement shall remain in full force and effect while you use the MySales, MyBackup Service or are a User. Even after MyBackup usage is terminated, this Agreement will remain in effect.
2. You may terminate your MyBackup usage at any time, for any reason via the Close Account form in the My Account section.
3. MySales may suspend the provision of MySales, MyBackup Service to you and/or terminate your MyBackup usage without notice to you if you:
1. Fail to pay any sums due to Us as they fall due.
2. Breach any term of this Agreement.
3. Are a company and you go into liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors.
4. MySales reserves the right, in its sole discretion, to suspend the provision of MySales, MyBackup Service to you and/or terminate your MyBackup usage at any time, without warning.

9. Privacy
1. Use of the MySales, MyBackup Service is also governed by Our Privacy Policy, which is incorporated into this Agreement by this reference.

10. Indemnity
1. You shall indemnify Us and keep Us indemnified and hold Us harmless from and against any breach by you of this Agreement and any claim brought against Us by a third party resulting from the provision of the MySales, MyBackup Service by Us to you and your use of the MySales, MyBackup Service including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by Us in consequences of your breach or non-observance of any of the terms of this Agreement including if any Content that you post on the MySales Websites or through the MySales, MyBackup Service causes MySales to be liable to another.

11. Limitation of Liability
1. MySales will not be responsible for any Data Content uploaded to the MySales MyBackup data vaults, whether caused by Users of the MySales, MyBackup Service or by any of the equipment or programming associated with or utilized in the MySales, MyBackup Service.
2. MySales is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or to technical problems or traffic congestion on the Internet or on any of the MySales, MyBackup Service or combination thereof.
3. MySales is not responsible for any error, omission, interruption, loss, deletion, defect, theft, destruction or unauthorized access to, or alteration of any Content you upload to the MySales, MyBackup Service, whether or not the MySales MyBackup software or Technician is to blame.
4. All conditions, terms, representations and warranties relating to the MySales, MyBackup Service supplied under this Agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in these terms and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded to the extent applicable under New Zealand law.
5. Nothing in these terms and conditions shall exclude Our liability for death or personal injury resulting from Our negligence.
6. Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the MySales, MyBackup Service shall be limited to the charges paid by you in respect of the services which are the subject of any such claim.
7. In any event no claim shall be brought unless you have notified Us of the claim within one month of it arising.
8. In no event shall we be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.
9. Non-Waiver
10. Any forbearance or failure by Us to enforce a provision to which you are subject shall not affect Our right to require such performance at any subsequent time, nor shall the waiver or forbearance by Us of any breach of any provisions of the agreement herein be taken to be or held to be a waiver of the provision or provisions itself of themselves.

12. Law
1. This Agreement shall be governed by and construed in accordance with New Zealand law and you hereby submit to the exclusive jurisdiction of the New Zealand courts.

13. Headings
1. Headings are included in this Agreement for convenience only and shall not affect the construction or interpretation of this Agreement.

14. Entire Agreement
1. These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between Us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between Us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to this Agreement, you confirm that you have not relied on any representation other than those expressly stated in this Agreement and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.

Frequently Asked Questions

Why are your online backups so cheap?

We do not like to think of ourselves as being cheap but rather, offering really good value for money. Unlike our competitors we do not have a large office or staff to maintain or pay, so in other words you get what you pay for. We could always charge more but we would feel we were doing our customers a disservice and in the long run that’s not good for anyone. We work from home but our systems are in the cloud, so because of that we can offer you a really good service and a great product at an exceptionally low price. We believe what we are providing is New Zealand’s best value cloud backup service.

How does your cloud backup work?

After we have received your order we will contact you by phone and arrange a time to install the software for you, we do this remotely with your permission. We then ascertain what programs you have, where the data is stored and ensure that the backup program is configured to include your relevant data. We discuss with you the best automated schedule and also setup the Management Service. Once we are happy we have everything we then start the first backup. The first backup may take several hours to complete. You can continue working but please do not turn off the computer until it is completed.

For larger businesses with dedicated servers we offer an online cloud backup image service which allows for recovery of hard drives this can be accessed both locally here in Nelson and also across the Internet.

What sort of Internet connection do I need if I don’t have fibre?

For MyBackup to work properly we need at least a VDSL connection with at least 20 Mb upload connection. For some customers who are still using ADSL we can under certain circumstances do a seed backup on-site and then cut you over to an incremental backup from then on. This can only be provided to certain areas in the Nelson – Marlborough region at this time.

I already have dropbox why do I need another backup program ?

Dropbox and other file synchronisation programs are very useful for distributing information and files to others, They differ from an online backup in the fact that MyBackup uses snapshot technology to make up to 90 incremental copies of your data. Also MyBackup runs in the background and is already pre-set up to backup your data automatically. You do not need to remember to make any further alterations to backup your data, you do not need to drag or drop files into a certain folder and because the online backup is done in the background as long as the computer is running your important files are stored on our servers.

How safe is my data ?

Your data is transmitted to our servers via a shared key, hashed SHA512. The data is encrypted and authenticated using AES-GCM, what that means is that your data is securely transmitted from your pc to our New Zealand servers. Our servers are replicated in real time so that your data is stored both here in New Zealand and also off-site, and offshore as well. This has been done so that we can ensure the data integrity and availability of your backups so that in worst case scenario short of a meteorite hitting New Zealand you will be able to access your information both reliably and easily.

What can we store in our backups?

Essentially anything that is valuable to you, if you are a photographer then it is for your photographs, if you are a draughtsman using CAD we can store your your CAD files, if you are a builder we can store store your plans, we can store your accounting databases, email files essentially anything that you need that you consider to be important to run your business. When we install the software we will make sure that what is important to you is saved.What we will not store is copyrighted material for which you do not own the copyright, objectionable material in any form and obviously if you are part of a terrorist organisation we would have some serious words.

Can I add extra backups ?

You have just been working over the weekend on some new documents for your business and your next scheduled backup is Tuesday. Can you add another backup now or do you have to wait for your next scheduled online backup. You can do a backup any time you like, on your desktop there is an icon labelled backup now just double-click on that and your backup will take place. We do not charge extra for this, as the whole goal of MyBackup is to ensure that your data is safe you can use this as many times as you like and there’s no extra charge.

How can I recover my data?

As part of your software installation we have included a PDF on step-by-step process of recovering data, if you need additional help please feel free to either ring or email us and we can help you over the phone, the first 10 minutes of this is free, and after that it is $35 per half hour. Generally we can sort out these problems in just a few minutes.

Do you do subscriptions?

We believe in open and free systems and as such we do not tie anybody into a subscription. You’re free to stay or free to leave according to your circumstances. The only thing that we require is if you want to leave that you please give us one months notice beforehand. We will hold your data on our servers one month after that date if you choose to recover it. We really don’t want to see you leave but we realise that circumstances change, businesses start, businesses finish and we want to be clear and transparent with all.

Do you offer a personal Backup service?

We are looking at offering a personal service in the very near future. Our packages will be starting from 10 GB and going to 20 GB. For as little as $7.95 per month. Please check our website to see when this will be available.

My backup is scheduled for today but it does not appear to have been completed?

At certain times of the day our servers are very busy and the backups are done on a first in first served basis sometimes that may mean that your backup client may have to wait for an additional 10 to 20 minutes but not to worry you’re in the queue and will be completed. The busy times for us will be from 9 am to 10 am in the mornings and between 3 pm and 5 pm and the afternoons the busiest day will be Friday between 3 pm and 5 pm. As long as your computer is turned on and connected to the Internet your backup will be done.  If your backup is scheduled on a Friday between three and five pm and after five pm the backup does not appear to have completed please leave your computer on and once the backup is complete your computer will go into sleep mode. And enjoy your weekend.

How long will you store my information?

For our file-based customers we will store your information for up to one year or 90 incremental backups whichever comes first. After that your current  backups will start replacing the oldest backups.
